The IRS requires employers to test whether their benefit plans unfairly favor Highly Compensated Employees (HCEs). Failure to adequately test and you’ll face big fines. Non-discrimination tests are often convoluted and hard to follow. Each year new calculations may be required and involves complex calculations and adherence to evolving regulations.
