PPACA Frequently Asked Questions
How do I know if my Group Health Plan is Grandfathered or Non-Grandfathered?
This information is typically best obtained directly from your health insurance carrier.
For a plan to be grandfathered, the group health plan must have been in place as of March 23, 2010 and must not have had any of the following changes:
- Significantly cut or reduced benefits
- Raised coinsurance charges
- Significantly raised copayment charges
- Significantly raised deductibles
- Significantly lowered employer contributions
- Added an annual limit or lowered any such annual limit on what the insurer pays
- Changed insurance carriers
Where is the HCR/PPACA Notice located?
The Notice is located online in MyTASC. Go to Files and select My Documents to view.
Who is responsible for distribution of the HCR/PPACA Notice(s)?
If an insurance company, a third party administrator, or some other third party provides the notice(s), the distribution requirement will be satisfied. The employer needs to make sure that the insurance company (if its plan is fully insured) or the third party administrator (if the plan is self-insured) has assumed the obligation of sending out the notice and will take responsibility if this is not done. Alternatively, if the insurance company or third party administrator is not willing to do this, then the employer needs to send out the notice.
When should the HCR/PPACA Notice be distributed?
The Notice should be distributed on or before the renewal of the group health plan (or new group health plan coverage) to ensure compliance with the PPACA and ERISA requirements.
To whom should the HCR/PPACA Notice be distributed?
The Notice must be furnished to all health benefit eligible employees.
How should the HCR/PPACA Notice be distributed?
The Notices must be furnished in a way reasonably calculated to ensure actual receipt of material and must be delivered using one or more methods likely to result in full distribution. Please see the Distributions instructions that were provided with your Notices package for more details.
Can a Group Health Plan become Grandfathered again after it has changed to Non-Grandfathered?
No, once a group health plan has lost its grandfathered status it cannot be regained.
I have an HRA, QSEHRA, and/or FSA. Am I required to provide my staff with PPACA/HCR Notices?
These Notices would not be required with a QSEHRA. However, with a regular FSA or HRA, these plans are similar to or work in conjunction with a health plan, therefore HCR/PPACA Notice(s) would be required.
Can you provide the Notice(s) in Spanish?
We do not provide Spanish-language versions of the Notices.
